Am I breaching any contract if I didn’t give commission to my agent?.. Its been 4- years now since my Lessee is renting out.. We have build a mutual relationship since we found out that we came from same school. Whenever he has a problem with the unit, I am fixing that even im residing out of the country. The agent will be calling if its time for renewal and just getting her commission. Me as owner and the lessee decided not to involve the agent when time of renewal. The agent keeps on harassing me through sending me messages on FB and even calling the lessee non stop just to get her commission.. i wanted to ask, Am I breaching a law or something if I didn’t mind the agent?

axibalj With the way the agent is handling the situation, it seems to me that he/she is a colorum broker. Someone who is acting as a leasing agent but isn't a licensed real estate broker. If your agent isn't a legal real estate practitioner or an illegal real estate practitioner, your contract with him is VOID from the very start because the real estate service he is performing is illegal. He/she isn't entitled to the commission fee that he/she isn't requesting and the agent can't bring it to court.
If he/she doesn't stop harassing you and the lessee, you can tell the agent that you will REPORT him/ her to the Bantay Colorum Task Force created by the Philippine Regulatory Board of Real Estate Service. Doing so, he/she can get punished with a fine of PHP 100, 000 to PHP 200, 000 or 2 to 4 years imprisonment or BOTH.

To my understanding, this would be based on your agreement with the agent [licensed or not]. Review the contract both of you signed and make time to have a talk. If you have decided to not involve the agent, you have to let the agent know about it before the renewal of the contract of the Lessee. Afterall, it is the agent who have helped you find a Lessee for your property.
